All seafarers have a responsibility for ensuring that no marine pollution is discharged from their vessel.

The Transport Operations (Marine Pollution) Act 1995 (TOMPA) was introduced to protect Queensland’s marine and coastal environment. TOMPA deals with discharges from ships into Queensland waters, which extend 3 nautical miles to seaward from the low water mark.

Penalties

The penalties for noncompliance with the Act are severe. If a court finds against a ship, the polluter may also be ordered to provide payment for the rehabilitation or restoration of the marine and coastal environment. Contact Maritime Safety Queenslands for penalty updates.
